strange!
and it works in other acts?
pressing AND releasing the alt key should toggle between act-menu and  
preset-menu on the next click.
are you sure you have the latest version?

this could be a naming conflict.
if you name presets exactly like the name of the act, max maybe tries  
to load that preset instead of the act.
have a look into your preset-folder..

please keep posting, if this does not help
